End User Stock License Agreement

Please read this End User Stock License Agreement ("Agreement") and Our Privacy Policy located at https://www.soldbyair.com/privacy carefully before clicking the "I Agree" button.

By clicking the "I Agree" button, You are agreeing to be bound by all of the terms and conditions of this Agreement. You also confirm that You have read and agreed with Our Privacy Policy. This Agreement is a legal agreement between You(collectively “You”, “Licensee”, “End User”) and SOLDBYAIR LLC(collectively "SOLDBYAIR LLC", “SoldByAir”, "Us", "We", or "Our").

If You do not agree to the terms of this Agreement, do not click on the "I Agree" button and do not attempt to download any content.

This agreement is between You and SOLDBYAIR LLC. You may not reassign this agreement to any other person or entity. We may assign this agreement to any person or entity as long as they are bound by these same terms.


“Stock Content” refers to images, video and/or audio files available for licensed purchase on the web page located at https://www.soldbyair.com/stock. We offer three types of licensing for Stock Content. “One Time Use”, “Lifetime Use”, and “Multiphoto Subscription”.

One Time Use - By purchasing a One Time Use license You are agreeing to use the 1 licensed piece of content for 1 project. After You have added the licensed Stock Content to your project You must delete all copies of the licensed Stock Content aside from that in the project. Licensed Stock Content may not be shared with anyone else and may not be made available for download. Content may not be posted on any websites except for MLS listing data(https://en.wikipedia.org/wiki/Multiple_listing_service).

Lifetime Use - By purchasing a Lifetime Use license You are permitted to use 1 piece of content for an unlimited number of projects. All projects must be your own. No other individual or entity may have control over or a substantial interest in projects that You use this content in. Content may not be shared with any other person or entity. You may not make licensed Stock Content available for download.

Multiphoto Subscription - By purchasing a Multiphoto Subscription You gain access to download any of Our Stock Content. Only download Stock Content You are utilizing in current projects. Do not stockpile Stock Content. You may share Licensed Stock Content with team members. Content may only be shared with the team to which the licensed user belongs. We may ask for a list of team members who will have access during account creation. This is not a license for brokerage wide sharing. Contact Us for brokerage pricing. Content may be used up until 30 days after the subscription has been terminated. After this point all licensed content must be deleted.


In addition to the above, You agree to all of the following.

• All Stock Content We provide to You is owned by SOLDBYAIR LLC or by the content contributors themselves. Any and all rights not granted by this agreement are reserved by SOLDBYAIR LLC and the content contributors.
• No licensed Stock Content may be resold
• We do not require attribution, though We appreciate it when You do.
• You agree not to use any licensed Stock Content in connection with a subject that may be considered controversial by a reasonable person (examples include drugs, sexual intercourse and others) without first obtaining written permission from SOLDBYAIR LLC.
• You agree not to use any licensed Stock Content in a defamatory, pornographic or unlawful manner.
• You may not use licensed Stock Content as part of a logo, trademark or business name.
• You will not use the licensed Stock Content in any electronic templates without permissions from SOLDBYAIR LLC
• You may not represent that You are the original creator of any licensed Stock Content
• You agree not to use any licensed Stock Content delivered by SOLDBYAIR LLC in a manner that would infringe upon any persons or entities copyright, intellectual property, privacy or trademarks rights.
• All licenses are non-exclusive to you. We can license Stock Content We provide to You to an unlimited number of other customers.
• You agree to be solely responsible for any edits made to the licensed Stock Content.
• At Our sole discretion We may discontinue licensing any Stock Content at any time. If We provide You notice or You have knowledge that any Stock Content is subject to an third parties infringement claim for which SOLDBYAIR LLC may be liable We may require You at your own expense to cease using and immediately delete or destroy any copies of Stock Content licensed to You.. We may also require You to immediately, at your own expense ensure that any customers, clients, employers, distributors, team members do the same. If We require You to do this, We will make a reasonable effort to provide You with replacement content free of charge.
• You agree that You will not use the content in a way to allows it to be downloaded, shared or redistributed by itself unless You have purchased a Team License which then allows You to share the files only with those on your Team.
• The licensing rights granted to You are non-transferable and non-sublicensable.
• You may not resell any licensed Stock Content. Licensed Stock Content may not be used in connection with products or services intended for resale if the primary value of those produces or services lies in the licensed Stock Content itself. Examples of this include but are not limited to, calendars, posters, DVDs, mugs, postcards or similar. If You wish to use any of Our Stock Content in this capacity You must first receive Our express permission in writing.
• You are responsible for all taxes imposed by any jurisdiction as a result of using any licensed Stock Content
• All Stock Content is provided “as is”.
• If You purchase a team membership, You authorize Us to charge You a subscription fee and taxes on a recurring basis. We may deactivate your membership without prior notice if We are unable to process payment or if You violate this Agreement.
• If You purchase a Team Membership You are responsible for ensuring Team members You share Content with abide by the license. You must alert Us immediately if there is any breach of security or license violation by You or any team member.
• Unless You purchased the Team Membership, only You may access or Us any of the licensed Stock Content.
• SOLDBYAIR LLC does not offer refunds for One Time Use or Lifetime Use licensed Stock Content. Refunds for Team Memberships are available during the first 7 days of membership provided that You do not download more than 3 files. All requests for refunds must be made in writing
• All requests for refunds/cancellations must be made in writing. In the event of cancellation, your rights to use the licensed Stock Content terminate, and You must delete or destroy any copies of the content.
• We do not guarantee the accuracy of location, description, metadata or other information related the content We provide to you.

• If your account is Terminated for violating this agreement You lose all rights to use any Content immediately. If Your account is Terminated for this reason You must delete all licensed Stock Content.
• If You use the licensed Stock Content on any platform or website and that platform or website uses it in a way that violates this agreement We may terminate Your account.
• If We have a reasonable belief that You have violated this agreement We may terminate your account prior to the end of the subscription period. You are required to pay any remaining balances in full.
• You agree to grant Us access to projects We request access to that contain any of the licensed Stock Content.
• Unless You have a Team Membership this agreement remains in effect indefinitely unless terminated by either party. For One Time Use and Lifetime Use licensed content, You may terminate this agreement by deleting all copies of licensed Stock Content.
• SOLDBYAIR LLC may terminate this agreement if You fail to comply with these terms.
• If this agreement is terminated for any reason SOLDBYAIR LLC may request a written statement from You verify that You have complied will all terms herein.
